Terms of Use for Online Shop
This Agreement (hereinafter referred to as the "Agreement") establishes the terms and conditions for using the online shop provided by Kyoto Sake Store (hereinafter referred to as the "Company") on this website (hereinafter referred to as the "Service"). All registered Users (hereinafter referred to as "Users") are requested to use the Service in accordance with this Agreement.
- Article 1 (Application)
This Agreement shall apply to all relationships related to the use of the Service between the User and the Company.
The Company may establish various regulations (hereinafter referred to as "Individual Provisions"), in addition to this Agreement, and rules for use. Regardless of their names, these Individual Provisions shall constitute part of this Agreement.
In the event of any inconsistency between the provisions of this Agreement and those of the Individual Provisions in the preceding paragraph, unless otherwise specified in the Individual Provisions, the provisions of the Individual Provisions shall take precedence.
- Article 2 (User Registration)
In the Service, registration applicants shall apply for User registration by agreeing to this Agreement and following the method prescribed by the Company. Upon the Company's notification of approval to the registration applicant, User registration shall be completed.
The Company may not approve a User registration application if it determines that the applicant falls under any of the following reasons, and shall have no obligation to disclose the reasons for such non-approval:
If false information is provided in the application for User registration.
If the applicant has violated this Agreement in the past.
If the Company determines that the registration is inappropriate.
- Article 3 (Management of User ID and Password)
Users are responsible for managing their User ID and password for the Service at their own risk. Under no circumstances should Users transfer, lend, or share their User ID and password with third parties. If a User ID and password combination matches the registration information and is logged in, it will be considered as usage by the User who registered the User ID. Except in cases where the Company has intentional or gross negligence, the Company shall not be liable for any damages caused by the unauthorized use of User ID and password by third parties.
- Article 4 (Sales Agreement)
In the Service, a sales Agreement shall be established when a User applies for a purchase to the Company and the Company notifies the User of acceptance of such application. Ownership of the product shall transfer to the User when the Company delivers the product to the shipping carrier. The Company may cancel the sales Agreement without prior notice to the User if any of the following reasons apply:
The User violates these Terms and Conditions.
Delivery of the product cannot be completed due to an unknown recipient address or prolonged absence.
The trust relationship between the Company and the User is deemed to be compromised.
Separate methods determined by the Company shall apply to payment methods, delivery methods, cancellation of purchase applications, and return methods related to the Service.
- Article 5 (Intellectual Property Rights)
The copyright or other intellectual property rights of the content provided by the Service, such as product photos and other content (hereinafter referred to as "Content"), belongs to legitimate rights holders such as the Company and content providers. Users are prohibited from reproducing, reprinting, modifying, or otherwise using the Content without permission.
- Article 6 (Prohibited Actions)
Users shall not engage in the following actions when using the Service:
Acts that violate laws or public order and morals
Acts related to criminal activities
Acts that infringe upon copyrights, trademark rights, or other intellectual property rights included in the Service
Acts that destroy or obstruct the function of the Company's servers or networks
Commercial use of information obtained through the Service
Acts that may hinder the operation of the Company's Services
Unauthorized access or attempted unauthorized access
Collection or accumulation of personal information of other Users
Impersonation of other Users
Acts that directly or indirectly benefit antisocial forces in connection with the Company's Services
Other acts deemed inappropriate by the Company
- Article 7 (Suspension of Service Provision)
The Company may suspend or interrupt all or part of the provision of the Service without prior notice to the User if any of the following reasons apply:
Maintenance or updating of the computer system for the Service
Difficulty in providing the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
Stoppage of computers or communication lines due to accidents
Any other reason deemed by the Company to make it difficult to provide the Service
The Company shall not be liable for any disadvantages or damages incurred by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.
- Article 8 (Restriction of Use and Deregistration)
The Company may, without prior notice, restrict all or part of the use of the Service or deregister Users if any of the following reasons apply:
Violation of any provision of these Terms and Conditions
Discovery of false facts in the registered information
Suspension of use of the credit card provided by the User as a payment method
Non-performance of payment obligations such as fees
No response to contact from the Company for a certain period
No use of the Service for a certain period since the last use
Other cases where the Company deems the use of the Service inappropriate
The Company shall not be liable for any damages caused to the User by the actions taken by the Company based on this Article.
- Article 9 (Withdrawal)
Users may withdraw from the Service through the prescribed withdrawal procedure.
- Article 10 (Disclaimer and Limitation of Liability)
The Company does not guarantee that the Service is free from defects, whether factual or legal (including defects in safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, errors, bugs, or infringement of rights). The Company shall not be liable for any damages incurred by the User due to the Service. However, in the event that the contract between the Company and the User regarding the Service (including these Terms and Conditions) falls under the Consumer Contract Act, this disclaimer shall not apply. Even in such cases, the Company shall not be liable for damages caused to the User due to non-performance of obligations or torts by the Company due to its negligence (excluding gross negligence), except for special circumstances in which damages arise from special reasons (including cases where the Company or the User could foresee the occurrence of damages).
The Company shall not be liable for any transactions, contacts, or disputes between the User and other Users or third parties regarding the Service.
- Article 11 (Change in Service Content, etc.)
The Company may change the content of the Service or suspend the provision of the Service without notifying the User, and shall not be liable for any damages caused to the User as a result.
- Article 12 (Amendment of Terms and Conditions)
The Company may amend these Terms and Conditions at any time without prior notice to the User if deemed necessary. However, if the User starts using the Service after the amendment of the Terms and Conditions, the User shall be deemed to have agreed to the amended terms.
- Article 13 (Handling of Personal Information)
We will handle personal information obtained through the use of this Service appropriately in accordance with our "Privacy Policy."
- Article 14 (Notification or Communication)
Notifications or communications between the User and our Company shall be conducted through methods designated by our Company. Unless otherwise specified by our Company, we will consider the currently registered contact information valid and will send notifications or communications to the registered contact address, which shall be deemed to have reached the User at the time of dispatch.
- Article 15 (Prohibition of Assignment of Rights and Obligations)
Without the prior written consent of our Company, Users may not assign or provide as collateral to a third party the position under the Service Agreement or the rights or obligations based on this Agreement.
- Article 16 (Governing Law and Jurisdiction)
The interpretation of this Agreement shall be governed by Japanese law. However, regarding this Service, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. In the event of a dispute arising concerning this Service, the exclusive jurisdictional court shall be the court having jurisdiction over our Company's head office location.
